These Terms of Service ("Terms") govern your access to and use of the TrackMyHomeCosts service, including the website at trackmyhomecosts.com and the web application (collectively, the "Service"), operated by TrackMyHomeCosts ("TrackMyHomeCosts," "we," "our," or "us").
By creating an account or using the Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Service.
If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.
To use the Service you must create an account. You agree to provide accurate, current, and complete information and to keep it updated. You must be at least 18 years old to create an account.
You are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account. Notify us immediately at contact@trackmyhomecosts.com if you believe your account has been compromised. We are not liable for losses caused by unauthorized access to your account.
Each account is for a single person. You may invite collaborators (see Section 4.3) but may not share your login credentials.
You agree not to use the Service to:
We reserve the right to suspend or terminate accounts that violate these rules (see Section 13).
You retain ownership of all data, records, and files you upload to the Service ("Your Content"). These Terms do not transfer any intellectual property rights to us.
By using the Service, you grant us a limited, non-exclusive, worldwide, royalty-free license to host, store, transmit, display, and process Your Content solely to operate and improve the Service. This license terminates when you delete the content or your account, subject to the retention schedule in our Privacy Policy.
If you invite collaborators to your account, you grant them access rights commensurate with the permissions you assign. You are responsible for all activity of your collaborators within your account.
You represent that you have all necessary rights to Your Content and that it does not violate these Terms or any applicable law.
The Service is currently offered free of charge to existing accounts. We reserve the right to introduce paid features, subscription plans, usage-based fees, or other pricing models at any time, and to set or change pricing for new accounts in our discretion. If we begin charging fees on your existing account, we will give you at least 30 days' advance notice and obtain your affirmative consent before any charges apply.
We aim for high availability but do not guarantee uninterrupted or error-free access to the Service. We may perform maintenance, upgrades, or emergency repairs that temporarily reduce availability.
We may add, change, suspend, limit, or discontinue features of the Service, in whole or in part, at any time and in our sole discretion, with or without notice. We are not liable to you or any third party for any modification, suspension, or discontinuation of the Service or any feature thereof, or for any loss or damage resulting from downtime, errors, or delays.
The Service, including its software, design, text, graphics, and other content (excluding Your Content), is owned by TrackMyHomeCosts and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or create derivative works from any part of the Service without our prior written consent.
The TrackMyHomeCosts name, logo, and product marks are trademarks of TrackMyHomeCosts. Nothing in these Terms grants you any right to use our marks.
If you submit suggestions, ideas, or feedback about the Service, you grant us a perpetual, irrevocable, royalty-free license to use that feedback without restriction or compensation to you. We are not obligated to act on any feedback.
The Service integrates with or links to third-party services (for example, cloud infrastructure providers). We are not responsible for the practices or content of those third parties. Your use of any third-party service is subject to that party's terms and privacy policy.
Certain features of the Service are powered by third-party artificial intelligence providers, currently including OpenAI, Anthropic, and Google Cloud AI. When you use these features, your inputs and the resulting outputs may be transmitted to and processed by those providers in order to generate a response. Use of AI features is subject to the applicable provider's terms, and you agree not to use the Service in any manner that would violate those terms. AI-generated output may be inaccurate, incomplete, or unsuitable for any particular purpose; you are responsible for reviewing it before relying on it. See our Privacy Policy for details on how data is handled in connection with AI features.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. WE DO NOT WARRANT THE ACCURACY OR COMPLETENESS OF ANY INFORMATION PROVIDED THROUGH THE SERVICE.
Some jurisdictions do not allow the exclusion of implied warranties, so the above exclusion may not apply to you.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, TRACKMYHOMECOSTS, ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU HAVE PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM OR (B) ONE HUNDRED DOLLARS ($100).
Some jurisdictions do not allow the limitation of certain damages, so these limitations may not apply to you in full.
You agree to indemnify, defend, and hold harmless TrackMyHomeCosts and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with: (a) your access to or use of the Service; (b) Your Content; (c) your violation of these Terms; or (d) your violation of any third-party right.
You may close your account at any time from Settings → Delete account. We will process the deletion as described in our Privacy Policy.
We may suspend or terminate your access to the Service at any time, with or without cause, with or without notice. Grounds for termination include violations of these Terms, conduct that we determine in our reasonable discretion is harmful to other users or to us, or extended account inactivity (greater than 24 months with no login).
Upon termination, your right to use the Service ceases immediately. Sections 4.2, 7, 8, 10, 11, 12, 14, 15, and 17 survive termination.

Informal resolution. Before initiating any formal proceeding, you agree to contact us at contact@trackmyhomecosts.com and give us 30 days to resolve the dispute informally.
Binding arbitration. If informal resolution fails, you and TrackMyHomeCosts agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Service will be resolved by binding arbitration administered by JAMS under its Streamlined Arbitration Rules, except that either party may seek injunctive or other equitable relief in any court of competent jurisdiction to prevent actual or threatened infringement of intellectual property rights.
Class action waiver. You agree to resolve disputes with us on an individual basis only. You may not bring a claim as a plaintiff or class member in any class, consolidated, or representative action.
Opt-out. You may opt out of this arbitration agreement by sending written notice to contact@trackmyhomecosts.com within 30 days of first accepting these Terms. Opting out does not affect any other provision of these Terms.
Time to file. Any claim arising out of or relating to these Terms or the Service must be brought within one (1) year after the claim arose; otherwise, the claim is permanently barred, except where applicable law prohibits such limitation.
These Terms are governed by and construed in accordance with the laws of the Commonwealth of Pennsylvania, without regard to its conflict-of-law principles. To the extent arbitration does not apply, you consent to the exclusive jurisdiction of the state and federal courts located in Allegheny County, Pennsylvania.
We may update these Terms from time to time. The effective date at the top of this page will reflect the current version. Your continued use of the Service after the effective date constitutes acceptance of the revised Terms.
